TELEMEDIA ACT (TMG)
The Telemedia Act (TMG) governs the legal framework for digital services and online offerings in Germany, such as websites, blogs, and social media profiles.
In the context of influencers, the TMG is particularly relevant with regard to the legal notice requirement. Influencers who use their accounts for business purposes – such as entering into partnerships or promoting products – are considered providers of telemedia and must provide an easily accessible legal notice.
The legal notice must contain certain information, such as name, address, and contact details, so that followers and authorities can identify who is behind the account.
The TMG thus complements other legal regulations, such as the Unfair Competition Act (UWG), and ensures greater transparency and legal certainty in the digital space. For influencers, complying with these requirements is therefore part of the professional use of social media to avoid legal consequences.
