HOW HIGH IS AN AGENCY COMMISSION ACTUALLY ALLOWED TO BE UNDER THE LAW?!
Many models wonder how high a modeling agency’s commission is actually allowed to be. The answer isn’t quite that simple, because standard industry practice and the legal assessment are often two different things.
In the modeling industry, agency commissions of 20 to 30 percent of the model’s fee are quite common. Many agencies also charge the client a service fee or booking fee. This is paid by the client and shouldn’t be confused with the commission that’s deducted from your fee. However, just because a commission is common in the industry doesn’t automatically mean it’s legally unobjectionable in every case.
A ruling by the Landgericht Düsseldorf (Düsseldorf Regional Court; case no. 8 O 126/08) received particular attention. The case dealt with the question of whether the rules of the former Vermittler-Vergütungsverordnung (German Ordinance on Placement Agents’ Remuneration) apply to modeling agencies. Under this ordinance, maximum limits on placement commissions applied to pure placement services. The ruling is still discussed in the industry today because it called into question whether certain commission models are permissible (please note that this ruling is not a landmark decision of the Bundesgerichtshof, Germany’s Federal Court of Justice).
What’s decisive, however, is the distinction between a pure placement agency and an agency that provides additional services. Many modern modeling agencies don’t see themselves merely as intermediaries; they also take on management, consulting, marketing, or career planning services. In such cases, the legal assessment may turn out differently than for pure placement.
What this means for models:
- Check carefully which services the agency actually provides.
- Pay attention to whether other fees are charged in addition to the commission.
- Question charges for comp cards, portfolio building, website listings, or administration.
- Ask for a transparent explanation of how the commission is calculated.
- Read contract clauses on commissions especially carefully.
A blanket statement like “20% is always allowed” or “anything over 18% is impermissible” would not be legally correct. Whether a commission is permissible always depends on the specific contract model, the agreed services, and the respective contract clauses.
If you’re unsure, or if you’re about to sign a long-term agency contract, having it reviewed by a lawyer can make sense. Especially with exclusivity agreements, high commission rates, or additional fees, it pays to get a professional assessment before you sign a contract.
Ultimately, what matters more than the amount of the commission alone is the question of what added value the agency actually offers. A reputable agency should bill transparently, provide services you can clearly understand, and actively help move your modeling career forward.
